ChargeShare is a peer-to-peer matchmaking app designed to connect homeowners/businesses with vacant chargers (hosts) to EV drivers within their community looking for a place to charge (renters). Our platform emphasizes safety and community, allowing users to match based on specific requirements and providing visual clarity of charging locations.

3. User Requirements and Responsibilities
• Eligibility:
• Users must be at least 18 years old.
• Users must have the rights to either rent or offer the chargers they are using.
• Responsibilities:
• Users must conduct themselves respectfully and foster a friendly community.
• Hosts must ensure their chargers are operational, safe, and legally permitted for use.
• Renters must use the charging facilities responsibly and respect the property of hosts.

4. Payment and Fees
• Fee Structure: Currently, we implement a service fee at the end of each transaction. A subscription-based model may be offered in the future.
• Payment Methods: Payments are processed via Stripe, accepting all methods supported by Stripe.
• Cancellations, Refunds, and Disputes:
• Users can request a refund at any time before a booking.
• A late cancellation fee applies if cancellation is requested within 1 hour of the booking.
• Each refund request will be evaluated on a case-by-case basis.
• Disputes should be reported to ChargeShare, which will mediate to the best of its ability.

5. User Content and Conduct
• Content Posting:
• Users can post photos, leave reviews, and communicate with one another.
• Users must not post any offensive, false, or misleading content.
• Conduct Guidelines:
• Users must treat each other with respect and not engage in any form of harassment or discrimination.
• Any illegal activity or misuse of the platform is strictly prohibited.

6. Liability and Disclaimers
• Disclaimers:
• ChargeShare provides a platform for connecting hosts and renters but does not directly control the interactions or transactions.
• ChargeShare cannot be held liable for any incidents occurring through the use of our platform. However, we will assist in resolving issues to the best of our ability.
• Limitation of Liability:
• Hosts and Renters assume full responsibility for their interactions and transactions on the platform.
• ChargeShare’s liability is limited to the maximum extent permitted by law. ChargeShare is not liable for any indirect, incidental, punitive, or consequential damages arising from the use of the service.

7. Termination and Suspension
• Account Suspension/Termination:
• We reserve the right to suspend or terminate accounts if users fail to meet our conduct standards.
• Users will be notified of any account suspension or termination.
• Data upon Termination:
• User data will be removed from our systems upon account termination, subject to legal requirements and our data retention policies.

8. Privacy and Data Security
• Privacy Policy: Our handling of user data is included within these ToS.
• Data Security: User data is stored securely within our database, and we take reasonable measures to protect it.
• User Data:
• Users consent to the collection, use, and sharing of their personal data as outlined in our privacy practices.
• Users have the right to access, modify, or delete their personal data as per our privacy policy.
• Communciation:
• We may contact users via phone, SMS, email, or in-app notifications for the purpose of:
Offering onboarding assistance;
Ensuring users can navigate the app effectively (e.g. pinning locations, how to match );
Providing support or addressing any technical issues users may face. These communications are service-related and intended to improve user experience. They are non-marketing in nature. Users can opt out of such communications at any time by emailing us at hello@chargeshare.uk.

9. Governing Law and Dispute Resolution
• Governing Law: These ToS are governed by the laws of the United Kingdom.
• Dispute Resolution:
• Disputes must be resolved between the involved parties as ChargeShare cannot be held liable.
• We encourage amicable resolutions and may facilitate mediation if necessary.
• If mediation fails, disputes may be resolved through arbitration in accordance with UK laws or through the courts in the jurisdiction where ChargeShare is based.

10. Changes to Terms
• Notification of Changes:
• Users will be notified of changes to the ToS via email or app updates.
• Continued use of the service after such updates constitutes acceptance of the new terms.
• User Agreement:
• By downloading and using the app, users agree to the terms and conditions.
